My personal opinion is that all unhelmeted motorcycle operators should be
required to be organ donors...that would make it all better! Helmets are
not part of the inspectable equipment on your motorcycle. Failure to use a
helmet is an omission on the part of the driver.

Sounds like they were wrongly convicted but that happens regularly. I
cannot tell you how many times I have had to educate a municipal prosecutor
on the law! County prosecutors are usually better.
